Ladder Injuries

Ladders are an unfortunately common cause of injuries and death in Massachusetts and throughout the United States.  According to the U.S. Centers for Disease Control and Prevention, ladders kill many Americans each year and injure thousands more.  Many ladder injuries occur in the workplace, per the U.S. Bureau of Labor Statistics.  Ladder injuries can also happen to pedestrians and other bystanders, frequently near construction projects.  While the Occupational Safety and Health Administration (OSHA) states that ladder injuries are preventable, ladder safety protocols are frequently violated, leading to injuries and death.

Ladder injuries can occur in a variety of ways.  Falling is one common ladder accident.  Other people are injured when an object is dropped off of a ladder onto them, or they are injured by the ladder itself.  Electrocution involving metal ladders is another source of injuries and death.  Ladder injuries can be severe and even fatal.  For those living with ladder injuries, the physical, emotional, and financial burden can be immense.

If you are struggling to recover from a Massachusetts ladder injury, you do not have to keep fighting alone.  An experienced legal advocate can help you understand your rights and recover fair compensation for your ladder injury.  Whether you were injured at work or as a bystander in a ladder accident caused by someone else’s negligence, you need a strong, versatile attorney to help make your best case and get justice for the toll your injuries have taken on your life.

Ladder Injury Attorney Tracy Paulsen and her law firm Rightful Legal represent clients in the Boston area, Suffolk County, Bristol County, Norfolk County, and throughout Massachusetts.  Attorney Paulsen fights for justice and the maximum possible compensation for every client.  If you are suffering from painful ladder injuries, incurred at work or as a bystander, reach out to Rightful Legal for help getting the compensation you deserve.

What Are Common Ladder Injuries in Massachusetts?

Our experience suggests that common Massachusetts ladder injuries include:

  • Fractures and broken bones.  These are especially frequent in falls from ladders.  Broken arms, broken wrists, and broken hips are all common.
  • Sprains and strains.  These can result from any type of ladder incident.  These injuries are not usually severe, but they can be painful and disruptive.  Complications can also arise.
  • Internal injuries.  These injuries are often associated with falls from ladders.  The force of your body hitting the ground can injure organs or other soft tissue.  These injuries can go undetected at first, leading to more severe issues.
  • Head injuries.  Traumatic brain injuries (TBIs), concussions, skull fractures, and other head injuries are commonly associated with ladders.  Head injuries can result from falling off a ladder, having an object dropped from a ladder onto your head, or being hit in the head by a ladder.  Head injuries, especially TBIs, can be catastrophic.  Head injuries can cause physical, neurological, and psychological symptoms.
  • Neck injuries.  Neck injuries can be associated with head injuries or occur on their own.  Neck injuries range in severity from mild to fatal.  Common symptoms include neck and/or shoulder pain, neck and/or shoulder stiffness, arm pain, and headaches.
  • Spinal cord injuries.  Falls from ladders can damage the spinal cord.  This is a serious injury, which is usually irreversible.  Spinal cord injuries can lead to pain, loss of sensation, paralysis, and loss of bowel and bladder control.

Other ladder injuries are possible.  Regardless of which ladder injury is affecting you, you can contact the team at Rightful Legal for help.

Who Pays Compensation for a Ladder Injury?

The party responsible for compensating you for a ladder injury depends on the circumstances of your injury.

If you were injured at work, your ladder injury claim may be one for workers’ compensation, where you seek compensation from your employer for lost income, medical expenses, and some limited other types of recovery.

If your ladder injury is from work and your employer or site manager was negligent, meaning they did not exercise the same basic level of care that other employers or managers would have under similar circumstances, you may be able to bring a personal injury claim.  Personal injury claims allow for more types of recovery when applicable, such as damages for pain and suffering.

If your ladder injury is not a work injury, but was caused by someone else’s negligence, you may be eligible to bring a personal injury claim against the negligent party.

Should You Get Medical Care for Your Ladder Injury?

Ladder injuries can be severe or even fatal.  It is wise to seek medical attention after any ladder injury, whether it is caused by a fall, having something dropped on you, or another safety issue.  In particular, if your head has been impacted or you have suffered a fall, you should call 911 or go to an emergency room right away.

You should be careful moving yourself or someone else after a ladder injury involving the head or neck.  It may be necessary to call 911 so that paramedics can transport the injured person for medical care.

If you do not seek medical treatment after a ladder injury, you may miss severe but hidden injuries such as internal bleeding or a traumatic brain injury.  Additionally, if you do not promptly get medical care, your employer or the defendant may use this as an excuse to question if you are telling the truth about how you were injured or how serious your ladder injuries are.  For your health and for your case, it is best to seek help from a medical professional as soon as possible following any ladder injury.

How Long Do You Have to Bring a Ladder Injury Case?

In Massachusetts, there are strict deadlines for legal claims.  This means there is an inflexible time limit for bringing your ladder injury lawsuit or workers’ compensation.  How much time you have to bring your claim depends on whether your injury is related to your work.

If the ladder injury is a personal injury, meaning it did not occur because of work and was caused by someone else’s negligence, you have only three years from the date you discover your ladder injury (usually the date of the incident) to bring a case.  It is imperative that you act promptly, and speaking to a personal injury attorney is an important first step.

If your ladder injury is a work injury, you have only four years from the date you discover that your injury is related to work (usually the date of the incident), to bring your workers’ compensation claim.  If you were injured on a ladder at work, notify your employer right away and speak to an attorney as soon as possible.

Why Should You Choose Rightful Legal to Represent You in Your Ladder Injury Case?

If you were hurt by a ladder accident, you may have the legal option to seek compensation.  If your ladder injury occurred at work, you may be able to receive workers’ compensation, including reimbursement for lost wages and medical expenses.  If your employer was negligent or if your ladder injury is not related to work, you may be able to bring a personal injury claim for your financial and personal losses, including lost income, medical bills, and more.  If you have tragically lost a loved one to a ladder-related injury, your family may have the right to bring a wrongful death claim.

For those who wish to bring a ladder injury claim in Boston, Attleboro, Bristol County, Plymouth County, or other areas of Massachusetts, Rightful Legal is here to guide you through the entire process.  From identifying whether yours is a workers’ compensation or personal injury claim, to collecting evidence and building a strong case, to representing you in court or at a hearing if necessary, Attorney Tracy Paulsen and her team are ready to Fight for Your Rights.  With a unique blend of compassionate client counseling and aggressive legal representation, Rightful Legal provides each client with personalized guidance and excellent customer service.
