E-Bike Accidents

Electronic Bicycles or “E-Bikes” have become a popular mode of transportation throughout Bristol County and surrounding areas in Massachusetts. Along with this rise in use, however, comes a troubling increase in e-bike and e-scooter accidents.  Such a high number of individuals have been injured or killed in accidents involving motorized bicycles that experts have declared them an emerging public health hazard.  The number of injuries form e-bikes have increased year over year, nearly doubling annually over a five year period. Unsurprisingly, emergency room visits for injuries involving e-bikes grew substantially over this same period.

E-bike accidents are significantly more likely to be fatal than accidents involving regular bicycles.  African American consumers are disproportionately affected by injuries caused by e-bikes according to a study by the US Consumer Product Safety Commission.

If you’re involved in an e-bike accident, you should seek immediate medical attention, and proceed to the nearest emergency room if you suspect a serious injury.  Once you are checked out and are medically stable, knowing your legal rights and options after an electronic bike accident is vitally important.  E-Bike Accident Attorney Tracy Paulsen can offer you a free-confidential case review to understand whether you have a claim and what to do next. Rightful Legal has successfully helped numerous e-bike injury clients recover the compensation they deserve.

Why are E-Bikes Considered Dangerous and What are Common in E-Bike Accident Injuries?

Electronic bicycles can result a host of injuries, with common injuries including:

  • Head injuries and traumatic brain injuries (TBIs)
  • Fractures and broken bones
  • Back injuries and spine injuries
  • Leg injuries
  • Neck injuries
  • Burns from fires caused by e-bike batteries

E-bike accidents in Massachusetts can involve:

E-bike accidents are often more dangerous than regular bicycle accidents because electric bikes can reach much higher speeds and are significantly heavier. This combination increases the force of impact during a crash, leading to more serious injuries such as traumatic brain injuries, broken bones, and internal damage. In Massachusetts, where e-bikes are commonly used on crowded city streets and shared paths, the risk is even greater due to close interactions with cars, pedestrians, and other cyclists. The added speed and power of e-bikes require quicker reaction times and better control, making any collision more likely to result in severe consequences. Motorized bicycle riders are often less likely to wear a helmet while riding leading to serious injuries.

Attorney Paulsen understands the critical nature of these cases as an avid cyclist herself. For Attorney Tracy Paulsen, representing those suffering from e-bike accident injuries is part of her passion for cycling and a career-long fight for justice.  After an e-bike accident, you need a strong advocate to ensure that you get the compensation you deserve.  Rightful Legal is on a mission to Fight for Your Rights and hold negligent and careless operators responsible for the harm they have caused you.

What Are e-Bikes or Motorized Bicycles?

E-bikes are bicycles that have been equipped with an electric motor that assists the rider with pedaling.  E-bikes still have pedals like regular bicycles, but the motor helps riders go faster, climb hills more easily, or ride longer distances with less effort.  E-bikes typically fall into three classes in the United States:

  1. Class 1: Pedal-assist only, with a max speed of 20 mph.
  2. Class 2: Pedal-assist and throttle (no pedaling needed), also maxes out at 20 mph.
  3. Class 3: Pedal-assist only, but goes up to 28 mph.

E-bikes are becoming a popular mode of transportation in Boston and surrounding areas in Massachusetts for commuting, recreation, and generally reducing car trips.  It is common for riders to use e-bikes in Massachusetts cities and towns, such as Boston, Cambridge and Somerville and surrounding areas, including Norfolk and Plymouth Counties and Cape Cod. E-Bikes are also popular and widely used among college students for their affordability and convenience.

Riders of all ages use e-bikes, including teenagers and children. The severity of pediatric injuries from e-bikes is particularly alarming.  In a recent study published by CHOC Pediatrics on April 25, 2025, researchers found that pediatric orthopedic injuries from e-bike accidents are as severe as those sustained in motor vehicle collisions. These high‑velocity, high‑energy impacts often result in multi-system trauma, including knee shattering, neurological damage, and internal injuries. This alarming trend underscores the urgent need for increased awareness, helmet use, rider education, and stricter safety regulations around e-bike use in Massachusetts.

If you have sustained serious injuries such as these from an e-bike accident, it is vital to contact an experienced Massachusetts E-bike Lawyer, who help you understand the extent of damages you may be entitled to and help you navigate these complex and potentially catastrophic injuries.

What Should You Do After a Massachusetts e-Bike Accident?

If you’re involved in an e-bike accident, staying calm and acting quickly can protect both your health and your legal rights. Here’s what to do:

  • Get to Safety: If you’re able to move, get out of traffic or harm’s way as soon as possible.
  • Call 911: Report the accident immediately. Stay calm, speak clearly, and give only the facts to the dispatcher.
  • Do Not Admit Fault: Avoid saying anything that could be taken as admitting fault, even if you think you might be responsible. Just describe what happened without making assumptions or blaming others.
  • Exchange Information: Get the names, phone numbers, and insurance info of everyone involved—including drivers, other cyclists, and any witnesses nearby.
  • Document the Scene: Use your phone to take photos and videos of your e-bike, other vehicles, injuries, road conditions, and any damage. These details can be very important later.
  • Seek Medical Care: Always see a doctor as soon as possible—even if you feel okay. Some injuries (like internal trauma or concussions) may not show up right away.
  • Talk to an E-Bike Lawyer Before the Insurance Company: Before speaking with any insurance company, contact Rightful Legal. We’ll help protect your rights, gather evidence, and fight to get you the compensation you deserve.

e-Bike Crash Lawyer Tracy Paulsen is here to guide you through this challenging time in the aftermath of your accident.

What Is the Law About e-Bikes in Massachusetts?

Massachusetts has some state laws addressing the use of electronic bikes. Specifically:

M.G.L. c. 90 s. 1B sets out the following:

  • You must be at least 16 to use an e-bike on the road.
  • E-bikes cannot go faster than 25 miles per hour on the road.
  • You need a driver’s license or learner’s permit to ride an e-bike on the road.
  • You have to wear a helmet when riding an e-bike on the road.
  • You must follow all the rules of the road on an e-bike, including avoiding roads where bicycles are prohibited.

M.G.L. c. 90 s. 1F prohibits motorized scooters and e-bikes on roads with speed limits in excess of 30 mph.  You can still cross a road with a speed limit of 30-45 miles per hour on an e-bike at an intersection.  Massachusetts cities and towns can ban e-bikes from specific roads for safety, so look out for signs stating e-bikes and other low-speed motor vehicles are prohibited.

What Types of Damages Can You Claim in an e-Bike Accident Injury Lawsuit?

Every case is unique, and the amount and types of compensation depend on factors like your age, the severity of your injuries, and your income.  Potential damages that Rightful Legal can help you understand and recover may include:

  • Medical expenses (both past and future)
  • Loss of income due to time missed from work (both past and future)
  • Compensation for pain and suffering
  • Compensation for emotional distress and mental anguish
  • Compensation for permanent physical and/or mental disability
  • Compensation for loss of ability to enjoy life

How Long Do You Have to Bring an e-Bike Accident Claim?

In Massachusetts, there is a three-year deadline to file a personal injury claim from an e-bike accident.  This three-year clock is very strict and starts ticking from the date your injury is discovered, which for most people is the day your e-bike accident occurs.

Waiting to take action on your e-bike accident case can cost you financial recovery for your injuries.  We at Rightful Legal know that it can be difficult to face your injuries and take that first step, but we are here to help and to guide you through the process.  Don’t put it off until it is too late to get compensation.  If you’ve been a victim of an injury in a collision or other motor vehicle accident involving an e-bike, take action today and contact Rightful Legal.
