Paraquat Herbicide Lawsuit

Paraquat Lawsuit Lawyer Tracy Paulsen is fighting for those exposed to this dangerous chemical who are now living with a debilitating condition called Parkinson’s Disease. Syngenta and Chevron, two primary defendants in this lawsuit, sold Paraquat as an herbicide for nonresidential use to control weeds in many agricultural and non-agricultural settings. Unfathomably this dangerous chemical is also linked to Parkinson’s disease.

For Paraquat Attorney Tracy Paulsen, representing farm workers and others harmed by exposure to this deadly herbicide is a fight for justice.  It is the mission of Rightful Legal to Fight for Your Rights and hold these chemical companies who never warned users of the dangers of these chemicals accountable for the harm they caused your or your loved ones.

An important update is worth noting – As of June 2025, settlements talks and negotiations are well underway for the MDL lawsuit, however, not cutoff or final resolution has been revealed.  There may still be time to partake in the MDL and also in the state court system for your Paraquat claim, but do not wait.

What Is Paraquat?

Paraquat was first made for commercial use in 1961.  This dangerous chemical is still one of the most popular herbicides in the world.  Paraquat(also known as Paraquat dichloride) is a chemical herbicide designed to kill stubborn weeds and grasses. It has been sold for decades under various brand names, including:

  • Gramoxone
  • Bonedry
  • Ortho-Paraquat
  • Devour
  • Blanco

Paraquat is still legal for commercial use in the U.S., but only individuals with a specific license can legally apply it. Its toxicity is extreme—just a small amount can cause serious harm. For those who worked with or lived near agricultural sites where Paraquat was used, the health consequences can be devastating.

How is Paraquat Used?

Farmers usually apply Paraquat by spraying it directly onto fields, aerosolizing massive amounts of this highly toxic chemical.  This can be done using tractors with sprayers, handheld equipment, or even crop-dusting planes.  Large commercial farms often rely on Paraquat because it works quickly and is effective even on tough weeds.  However, this effectiveness comes at a tremendous cost to the health of farm workers and nearby residents.

How Can You or a Loved One Be Exposed to Paraquat?

Agricultural workers and farmworkers, landscapers and pesticide applicators, are the most likely to be exposed to Paraquat.  They may come into contact with the chemical while mixing it, loading it into sprayers, or applying it to crops.  Exposure can happen if Paraquat gets on their skin, is inhaled, or is accidentally ingested.  Even small, repeated exposures can be harmful over time.

People who live near farms where Paraquat is used may also be at risk.  When Paraquat is sprayed, tiny droplets or particles can drift in the air and settle in nearby homes, gardens, or on outdoor surfaces.  This is called pesticide drift, and it can lead to low-level but ongoing exposure for nearby residents.  Even tiny amounts of toxic Paraquat can cause Parkinson’s Disease over time.

Exposure can also happen when farmworkers bring home contaminated clothing, shoes, or tools, which can unintentionally expose family members.  In rare cases, improper handling of Paraquat can lead to contamination of soil or water, causing mass exposure, especially near storage or mixing areas.

What is Parkinson’s Disease?

Parkinson’s Disease is a progressive brain disorder that disrupts a person’s ability to move, speak, and function. Symptoms may include:

  • Muscle tremors or shaking
  • Difficulty walking or balancing
  • Stiffness in the arms and legs
  • Slow movement
  • Fatigue, confusion, and speech changes

Over time, Parkinson’s can severely impact independence and quality of life, often requiring full-time care. Sadly, there is no cure for Parkinson’s disease and the toll this takes on the person and their family is profound and difficult.

How Does Paraquat Cause Parkinson’s Disease?

Paraquat harms the brain. Recent research has found a strong link between repeated exposure to Paraquat and the development of Parkinson’s Disease. When inhaled, absorbed through the skin, or accidentally ingested, Paraquat may damage parts of the brain that regulate movement. Over time, this damage can lead to the same kind of neurological degeneration seen in Parkinson’s patients.

Scientists have found that the chemical may interfere with dopamine-producing cells, accelerating the loss of motor function and balance. These effects often appear gradually and worsen over time, eventually requiring lifelong care and treatment.

What Is the Paraquat Lawsuit?

Thousands of individuals across the United States have filed lawsuits against the manufacturers of Paraquat, alleging that prolonged exposure to this toxic herbicide caused them to develop Parkinson’s Disease. These cases have been consolidated into a Multi-District Litigation (MDL No. 3004) in the United States District Court for the Southern District of Illinois, overseen by Chief Judge Nancy J. Rosenstengel.

This consolidation allows similar claims to move more efficiently through the legal process while preserving each person’s individual right to pursue compensation.

According to publicly filed court records (In re: Paraquat Products Liability Litigation, MDL 3004), the lawsuits claim that manufacturers like Syngenta and Chevron USA Inc.:

  • Marketed Paraquat without providing adequate warnings about neurological risks
  • Knew or should have known of studies linking Paraquat to brain cell damage and Parkinson’s Disease
  • Failed to disclose internal research and actively tried to discredit emerging science

Court documents suggest these companies may have withheld important safety data while continuing to profit from widespread commercial use. The Paraquat MDL now includes nearly 6,000 active cases, with more being added as victims come forward.

Paraquat MDL Settlement

In April 2025, the lawyers in the Paraquat MDL filed a joint motion asking the Seventh Circuit to pause their appeal.  The lawyers told the Court they had entered into a signed settlement framework that could resolve many cases in the MDL.  The Court indicated that a settlement would be efficient and that it will not oppose this request.

The parties asked for 60 days to continue working together and provide the Court with an update.

What Could a Paraquat Lawsuit Case be Worth?

If you’ve been diagnosed with Parkinson’s Disease after Paraquat exposure, you may be eligible for compensation to cover:

  • Current and future medical bills
  • Lost income or job loss
  • Pain and suffering
  • Rehabilitation and long-term care
  • Loss of independence and quality of life
  • Emotional and mental distress

Settlement amounts vary, but experts anticipate that individual cases could result in payouts ranging from tens of thousands to over a million dollars—depending on your circumstances.

Did Manufacturers Know About the Dangers of Paraquat?

Internal documents and investigative reports suggest that Syngenta, the manufacturer of the herbicide Paraquat, may have been aware of its link to Parkinson’s disease for decades.  Not only did the company fail to warn people, it also took steps to conceal this information.

Court-ordered internal documents, often referred to as the “Paraquat Papers,” reveal Syngenta was aware of research indicating an association between Paraquat and Parkinson’s disease since at least 2001.  Despite this knowledge, the company continued to market the herbicide without adequate warnings about its health risks.

Investigations have uncovered that Syngenta engaged in efforts to refute scientific research linking Paraquat to Parkinson’s disease. Documents detail attempts to discredit studies and derail the nomination of EPA advisers who might have influenced regulatory decisions regarding the herbicide.

Further reports indicate Syngenta also withheld internal research showing Paraquat’s harmful effects on brain tissue from regulators.  The company downplayed the validity of similar findings reported by independent scientists, thereby limiting public awareness of all the neurological risks associated with Paraquat exposure.

These revelations have emerged amid ongoing litigation, with over 5,800 active lawsuits consolidated in the MDL in Illinois.  Plaintiffs allege that Syngenta failed to warn about Paraquat’s risks, even as more and more scientific studies linked the herbicide to Parkinson’s disease.  In response, Syngenta has initiated the settlement process described above, though it denies wrongdoing and maintains no peer-reviewed analysis proves a definitive connection between Paraquat and Parkinson’s disease.

The company’s actions have drawn comparisons to previous cases where corporations concealed health risks associated with their products, raising concerns about corporate responsibility and the protection of public health.  Paraquat Law Firm Rightful Legal is on a mission to hold corporations responsible and force future corporate transparency regarding dangerous products.

Why Should You Contact a Paraquat Attorney Today?

First, to determine if you are eligible to bring a claim.

You may be eligible to bring a claim and obtain significant compensation in the Paraquat settlement if:

  • You have been diagnosed with Parkinson’s Disease, AND
  • Before your diagnosis, you were exposed to a product containing Paraquat.

Even if you have not been exposed to Paraquat for many years, you could still be discovering the injuries caused by previous exposure.

If eligible, you should seek counsel as soon as possible.  Proving causation of Parkinson’s Disease by Paraquat Herbicides is difficult, and chemical manufacturers are known to spend enormous amounts of money on defense and fight dirty to escape responsibility.  Paraquat Lawyer Tracy Paulsen and Rightful Legal are passionate about holding chemical companies accountable for the injuries they have inflicted on unsuspecting agricultural workers and rural residents.

It is important to act swiftly if you are eligible to bring a Paraquat claim.  There are statutes of limitations for filing a personal injury claim, including those caused by chemicals.  The applicable time limit varies by state, but often begins to run the moment your injury is discovered.  This may be the date your Parkinson’s Disease diagnosis or the date you discovered that your injury may have been caused by Paraquat exposure.  There is no time to waste.

When your health has been stolen by a toxic chemical like Paraquat, you deserve more than just answers — you deserve justice, accountability, and compensation.

At Rightful Legal, we don’t treat you like a case file. We treat you like a human being whose life was unfairly disrupted by a product that should have been safe.

Attorney Tracy Paulsen has spent over 15 years standing up to corporations that put profits over people. She understands that victims of chemical exposure often had no idea they were at risk — they were simply working in the fields, applying pesticides, or living near farmland when the damage was done.

What makes Rightful Legal different? We know how to take on the chemical giants — and win.

  • Provide a free, private consultation to discuss your potential Paraquat claim
  • Investigate your occupational and environmental exposure history

Time is running out on the Paraquat Herbicide Lawsuit. If you feel you may be eligible, now is the time to act.
