Tylenol Autism Lawsuit Update: Appeals Court Revives More Than 500 Lawsuits
There’s big news in the Tylenol autism lawsuit this week. More than 500 lawsuits involving Tylenol, autism, and ADHD have been given one more chance to move forward in federal court.
A court decision on October 16th was a significant turning point for families involved in this litigation.
I’m Attorney Tracy Paulsen, founder of Rightful Legal, and each week I’ll bring you updates on major lawsuits affecting families across the country.
Now, here’s what happened.
Background of the Federal Tylenol Autism Litigation
Back in 2023, a federal judge excluded key expert testimony in the Tylenol autism litigation. That decision eventually led to hundreds of cases being dismissed.
Federal Appeals Court Revives More Than 500 Tylenol Autism Lawsuits
But in July of 2026, a federal appeals court reversed important parts of that ruling and reinstated three of the plaintiffs’ expert witnesses.
That decision revived more than 500 lawsuits.
October 16 Court Decision Allows Tylenol Autism Litigation to Move Forward
The companies involved asked the appeals court to reconsider, and on October 16th, the court said no.
So, what does this mean for families?
It means hundreds of Tylenol autism lawsuits now have the opportunity to move forward through the legal process.
Tylenol Use During Pregnancy and Autism and ADHD Allegations
These lawsuits allege that taking Tylenol or another medication containing acetaminophen during pregnancy may have contributed to children being born with autism or ADHD.
What the Appeals Court Did Not Decide About Tylenol and Autism
Now, it’s important to understand that these allegations have not been proven.
The appeals court did not determine that Tylenol causes autism or ADHD, and the scientific evidence remains disputed.
But the decision does allow the litigation to move forward.
Tylenol Autism Lawsuit Settlement Update
And here’s another important question we’re hearing: Is there a Tylenol autism settlement on the horizon?
As of October 20th, there has been no announced global settlement in this federal litigation, and there’s no guarantee of compensation for families bringing these claims.
But the good news is that families who believe they’ve been injured can still move forward.
