To be fully transparent, the outcome of that hearing raised concerns. The court expressed skepticism about the scientific evidence linking PFAS exposure to liver and thyroid cancer, specifically regarding the strength of the connection and the required level of exposure. This could result in lower settlement values or additional hurdles for those types of claims.
Which PFAS Injuries Are Most Likely to Qualify?
Despite concerns around liver and thyroid cancer, there are three conditions with the strongest evidence and highest likelihood of compensation:
- Kidney Cancer
- Testicular Cancer
- Ulcerative Colitis
These conditions will be the central focus of an upcoming Daubert hearing scheduled for September 19, 2025, where the court will decide what expert evidence will be allowed at trial.
Additionally, the first bellwether trial focused on kidney cancer is set for October 2025—a major milestone in this litigation.
Settlement Negotiations Are Underway
Settlement talks are intensifying behind the scenes. The court is applying pressure on both plaintiffs and the chemical manufacturers to reach an agreement. There is real momentum toward a global settlement of personal injury claims related to PFAS water contamination.
