Emerging National Litigation Involving Olympus Medical Scopes
There is an emerging national litigation involving Olympus medical scopes that I wanted to bring to your attention.
I am Attorney Tracy Paulsen, founder of Rightful Legal.
How Olympus Scopes Are Reused
Here is the concern and the disturbing news.
Olympus scopes are reusable devices. They essentially go inside the body, they are cleaned, and then they are used again on another patient.
Lawsuits Allege Cleaning and Design Issues
Lawsuits now allege that certain Olympus scopes may have been defectively designed because they could not be fully cleaned, even when hospitals followed the cleaning instructions.
That means, disturbingly, that bacteria or biological material could remain trapped inside tiny channels or moving parts of the scope.
If that happens, one patient’s infection can potentially be passed to the next healthy patient.
Serious Infection Risks After Scope Procedures
These cases may involve sepsis, hospitalization, organ failure, antibiotic resistance, superbug infections, and in some cases, even death.
Some claims may also involve exposure to HIV or tuberculosis, but those cases can be harder because proving the source of transmission is more complex because of delays in diagnosis.
Who May Be Eligible for an Olympus Scope Lawsuit
You may be eligible for an Olympus scope lawsuit if you had a scope procedure since 2015 and developed a serious infection within 30 days, especially if you needed antibiotics, hospitalization, or were diagnosed with a superbug infection.
Olympus Scope Cases May Involve Product Liability
That is not usually a medical malpractice case. It may be a product liability case involving defective design, failure to warn, and failure to provide safe cleaning instructions.
What To Do After a Serious Infection From a Scope Procedure
If you became seriously sick, or a loved one became seriously sick after a routine scope procedure, do not assume that it was just bad luck.
You may have a case against the manufacturer.
