Lindsay Clancy Trial Update: Criminal Verdict, Wrongful Death Lawsuit and Medical Malpractice Claims
Lindsay Clancy Murder Trial and the Larger Legal Story
The Lindsay Clancy murder trial is now in the hands of the jury, but the criminal verdict is only one part of the legal story surrounding this case.
I’m attorney Tracy Paulsen, founder of Rightful Legal, a Massachusetts-based law firm.
Lindsay Clancy Criminal Case Update
As of midday today, jurors in Plymouth Superior Court are on their third day of deliberations. They have deliberated so far for more than 13 hours without reaching a verdict.
Clancy is charged with three counts of first-degree murder in the deaths of her children, Cora, Dawson, and Callan.
Possible Verdict Options in the Lindsay Clancy Trial
The jury has five potential verdict options for each charge: first-degree murder, second-degree murder, manslaughter, not guilty, or not guilty by reason of lack of criminal responsibility.
Defense Argument and Postpartum Psychosis
The defense does not dispute that Clancy killed her children. Its central argument is that she was suffering from severe mental illness, including what the defense describes as postpartum psychosis, and was not criminally responsible at the time.
Prosecution’s Position
Prosecutors, on the other hand, argue that despite her mental health condition, she understood what she was doing and that she acted deliberately.
Separate Wrongful Death Lawsuit
At the same time, Lindsay Clancy’s former husband, Patrick Clancy, has a separate wrongful death action pending in Norfolk Superior Court.
Patrick filed that case individually and as the personal representative of the estates of his three deceased children.
The defendants are psychiatrist Dr. Jennifer Tus, nurse practitioner Rebecca Jolada, Aster Mental Health, and South Shore Health Systems.
Importantly, those are allegations, not findings.
Medical Malpractice Allegations
The complaint claims that the providers negligently prescribed and managed Lindsay’s medications, that they failed to adequately monitor her deteriorating psychiatric condition, and that they failed to take reasonable steps in response to signs including suicidal ideation.
Patrick alleges that those failures caused or contributed to the deaths of his children.
The complaint seeks damages for wrongful death and also includes a conscious pain and suffering count and a separate claim against South Shore Hospital.
Status of the Lindsay Clancy Civil Case
The civil case remained open as of August 21st, and the next scheduled hearing is on October 28th.
Criminal Case vs. Civil Wrongful Death Case
And here is the critical legal distinction.
Whatever the jury decides about Lindsay Clancy’s criminal responsibility does not automatically decide whether her health care providers were negligent.
Those are separate cases involving different defendants, different legal standards, and different burdens of proof.
What the Criminal Verdict Means for the Civil Litigation
So, when the criminal verdict comes down, this litigation may be far from over.
