How Did PFAS Chemicals Get Into Our Drinking Water?
Good afternoon. Attorney Tracy Paulsen of Rightful Legal.
Today I wanted to discuss a question that I’ve been getting a lot from clients in the PFAS personal injury multi-district litigation lawsuit.
The question is: How did PFAS chemicals get into my drinking water supply?
Sources of PFAS Water Contamination
Well, the answer is that it’s not so simple.
If you are drinking from a water supply that’s from the groundwater—like many cities and towns are in the United States—then it’s more likely than not that your water may be contaminated.
They’re contaminated from a variety of sources. It comes from manufacturers who utilize PFAS in their industrial processes and in their consumer products.
But people are standing up and fighting back.
Example: Town of Nyack Lawsuit
For instance, the town of Nyack in New York recently filed a lawsuit against Estée Lauder and Teva Pharmaceuticals for utilizing PFAS compounds in their products and in their industrial processes, and dumping it into the ground—which has led into the aquifer and directly through people’s faucets into their systems.
Firefighting Foam and Military Exposure
Also, as you might see a lot, there is a lot of exposure from aqueous firefighting foam. That is utilized obviously at fire stations, and also through military bases for training exercises.
There is a new order by the federal district court judge in South Carolina, where 12 sites are actually going to be studied. This will be really integral in the current pending litigation.
This is to determine where the products came from—because military bases and airports will keep records of where they bought the firefighting foam from. This can lead back to the direct manufacturer, whether it be 3M or another defendant.
Lawsuit Status: Litigation Is Moving Fast
So this litigation is evolving at a very rapid pace.
Also with that, the time to be part of this personal injury lawsuit is time-barred. It’s urgent.
If you have experienced:
- Kidney cancer
- Liver cancer
- Thyroid cancer
- Ulcerative colitis
- Testicular cancer
…then you may have a claim.
Time Is Limited: Contact a Lawyer Now
It’s very vital that you contact an attorney right away, because these claims will be time-barred by the statute of limitations.
Many states have a discovery rule, like they do in Massachusetts. So it’s not just the date of the diagnosis of your injury, but also the date that you would have known that the harm was caused by PFAS.
In coming years, old cases will not be able to come forward.
